A Texas man is suing fast-food chain Whataburger to the tune of nearly $1 million for allegedly not holding the onions on his order, causing an allergic reaction.
The rogue onions sent Demery Ardell Wilson to the doctor, he says, and he is now claiming that Whataburger “failed to act in accordance with the appropriate standard of care” and thus inflicted “serious personal injuries” in not withholding the offending vegetable as he requested, KXAS-TV reported.
Wilson was forced to “seek the care of medical professionals” after the July 24, 2024, visit, according to a copy of the complaint obtained by USA Today. He’s accusing Whataburger of negligence and wants between $250,000 and $1 million in damages, penalties and other costs.
Onion allergy is rare, though even a sensitivity to onions can cause hives, cramping, gas or swelling around the mouth, according to Healthline.
While Wilson filed the original suit in the 269th Judicial District Court of Harris County, Texas, on April 25, Whataburger demanded “strict proof” in a separate filing last Friday, USA Today reported.
Wilson contends that the meal was served to him “in a defective or unreasonably dangerous condition.”
Whataburger execs are keeping mum, since the litigation is pending, and declined to comment to media outlets.
This was not Wilson’s first fast-food lawsuit rodeo. His 2024 suit against Sonic Drive-In over the same issue was dismissed a month after being filed, KXAS reported.
