Department of War opens misconduct probe into Sen. Mark Kelly after Trump accused him of sedition

The Department of War has opened a probe into “serious allegations of misconduct” against Sen. Mark Kelly that could result in court-martial proceedings, just days after President Trump accused him of seditious behavior.

Without providing details of what offenses Kelly (D-Ariz.), a retired Navy captain, is accused of committing, the Department of War vowed to conduct a “thorough review.”

“This matter will be handled in compliance with military law, ensuring due process and impartiality,” the Department of War said. “All servicemembers are reminded that they have a legal obligation under the UCMJ [Uniform Code of Military Justice] to obey lawful orders and that orders are presumed to be lawful.”

“A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.”

Kelly was one of six Democratic veterans who drew Trump’s wrath last week for imploring service members to “refuse illegal orders.”
