Manhattan DA charges suspects involved in shooting of off-duty Customs and Border Patrol agent


State prosecutors in Manhattan brought charges Wednesday against the suspects involved in the July shooting of an off-duty Customs and Border Patrol agent in an uptown park.

Miguel Mora, 21, was hit with attempted murder in the first and second degrees for the July 19 shooting in Fort Washington Park. Mora and his alleged accomplice, Christhian Aybar, 22, were also hit with assault, robbery, criminal possession of a weapon and related offenses in an 11-count indictment unsealed in Manhattan Supreme Court. The pair are already facing federal charges.

At a press conference Wednesday, District Attorney Alvin Bragg alleged the two men plotted robberies over WhatsApp the day of the shooting and rode into the park on a moped at around 11:45 p.m., first targeting a 39-year-old woman sitting on a bench, grabbing her phone.

The duo allegedly then rode north toward a lighthouse at the foot of the George Washington bridge and clocked the off-duty CBP officer sitting with a woman on a jetty. Mora got off the moped, crept along the rocks, and pulled out a gun and pointed it at the agent’s head, who pulled his own gun, exchanging fire with Mora, authorities allege.

The off-duty agent was struck in the face, hand and wrist and is recovering following his discharge from the hospital. He shot Mora in the thigh and groin, according to court docs. Aybar allegedly drove Mora to a Bronx emergency room, where Mora was arrested. Aybar was apprehended by the feds the next day.

Both men are also facing federal charges being handled by the Manhattan U.S. attorney’s office. In that case, Mora, who’s been hospitalized since the incident, is federally charged with one count of possession of ammunition, and Aybar is accused of being an accessory after the fact by allegedly acting as a getaway driver.

Bragg declined to shed light on Mora’s condition when asked by the Daily News. He commended the agent’s quick thinking.

“We don’t know what would have happened if he had not acted courageously, and again, off-duty,” the DA said.

Mora and Aybar are expected to appear in state Supreme Court for their arraignments the week of August 18, Bragg’s office said.

President Trump’s immigration officials have sought to hold up the men, who are from the Dominican Republic and are undocumented, as examples of what they claim is a surge of violent crime in the nation’s sanctuary cities.

NYPD data shows shootings in the city are at an all time low.
